Former U.S. President Donald Trump attends the Trump Organization civil fraud trial, in New York State Supreme Court in the Manhattan borough of New York City, U.S., October 25, 2023. In that case, Trump is prohibited from publicly targeting Smith or potential witnesses, both of whom he has frequently referenced online and on the campaign trail. "He is a judge that found me GUILTY before the trial even started," Trump said of Engoron in his social media screed Thursday. Engoron fined Trump $5,000 in that instance and warned him that future violations would yield more severe sanctions, potentially including imprisonment. Former U.S. President Donald Trump attends the Trump Organization civil fraud trial, in New York State Supreme Court in the Manhattan borough of New York City, October 25, 2023. The American Civil Liberties Union argued Wednesday that the gag order slapped on former President Donald Trump in his federal election interference case violates the U.S. Constitution. The ACLU, a frequent and vocal critic of Trump that applauded his criminal indictment in the federal case in Washington, D.C., said that the restrictions placed on his speech run afoul of the First Amendment. "No modern-day president did more damage to civil liberties and civil rights than President Trump," said the group's executive director, Anthony Romero, in a press release. "But if we allow his free speech rights to be abridged, we know that other unpopular voices — even ones we agree with — will also be silenced," Romero said.

WASHINGTON (AP) — Lawyers for Donald Trump are raising new challenges to the federal election subversion case against him, telling a judge that the indictment should be dismissed because it violates the former president's free speech rights and represents a vindictive prosecution. Special counsel Jack Smith's team urged a judge last week to reject that argument and is expected to do the same for the latest motions. It is routine for defendants to ask a judge to dismiss the charges against them, but such requests are rarely granted. In Trump's case, though, the challenges to the indictment could at a minimum force a delay in a prosecution that is set for trial in Washington next March. That happened Sunday when Trump posted on social media, in capital letters, that Powell “was not my attorney, and never was." Smith's indictment notes Trump privately told others that he thought her election fraud ideas sounded “crazy." Campaigning in New Hampshire on Monday, Trump appeared to refer to Powell and Cheesbro as “good people” and said prosecutors worked to “hound” and “scare” them. Steve Sadow, Trump's lead attorney in the Georgia case, expressed confidence that Powell’s plea wouldn’t hurt Trump, saying last week that any truthful testimony offered would be "favorable to my overall defense strategy." The Georgia indictment accuses Powell in a plot to illegally access a county's voting equipment.

Former President Donald Trump's lawyers told a court Tuesday that they are appealing a narrow gag order imposed on him in his federal 2020 election interference case. But Chutkan, who was appointed by President Barack Obama, said Trump can't mount a “smear campaign” against prosecutors and court personnel. At rallies and in social media posts, Trump has repeatedly sought to vilify Smith, other prosecutors, likely witnesses and even the judge. Smith’s team argued that Trump knows that his incendiary remarks could inspire his supporters to threaten or harass his targets. The case, which accuses Trump of scheming to subvert the results of the election, is scheduled to go to trial in March.

Judges can threaten gag order violators with fines or jail time, but jailing a presidential candidate could prompt serious political blowback and pose logistical hurdles. A gag order may also slow down the case because it's likely Trump either violates it and the judge will want to punish him or Trump will challenge the order in advance, he said. In one case, a federal appeals court in 1987 lifted a gag order on U.S. Rep. Harold Ford Sr., a Tennessee Democrat charged in a fraud case. Ford’s gag order prohibited him from even sharing his opinion of or discussing facts of the case. He said he was dubious that Trump’s attacks, “while in very poor taste,” posed the kind of danger to merit a gag order.

They pointed to Trump's recent disparagement of the clerk of the New York judge overseeing a civil case against him that caused the judge to issue a limited gag order. Smith's team wants the judge to issue a written questionnaire to weed out potential jurors before jury selection begins in the case scheduled for trial in March. "Such a precaution is not only necessary to ensure that all parties handle sensitive juror information responsibly, but also so that the Court can assure prospective and seated jurors in this case that no party will improperly use their names or other identifying information," prosecutors wrote. After he left the White House, former President Donald Trump allegedly shared sensitive information about U.S. nuclear submarines with an Australian billionaire who is a member of his Mar-a-Lago club, according to a pair of reports published on Thursday. Trump shared the information with Anthony Pratt during an April 2021 conversation at the Palm Beach, Fla., golf club, according to ABC News, which first reported the development. The New York Times also confirmed the former president shared the information with Pratt, citing two people familiar with the matter. Trump shared the number of warheads that U.S. submarines typically carry and how close they can get to Russian submarines without being detected, according to both ABC and the New York Times. Trump didn't show any government documents to him during the meeting or any other time at Mar-a-Lago, sources told ABC News.

WASHINGTON (AP) — Lawyers for former President Donald Trump have asked a judge to postpone his classified documents trial until after next year's presidential election, saying they have not received all the records they need to review to prepare his defense. The trial on charges of illegally hoarding classified documents, among four criminal cases the Republican former president is facing, is currently scheduled for May 20, 2024, in Florida. In a motion filed late Wednesday, Trump's lawyers urged U.S. District Judge Aileen Cannon to push back the trial until at least mid-November 2024. The presidential election is set for Nov. 5, 2024, with Trump currently leading the GOP field in the months before the primary season. The defense lawyers say Trump's two co-defendants in the case, his valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira, are joining in the request.

Lawyers for former President Donald Trump are slamming prosecutors' request for a narrow gag order in his 2020 election subversion case in Washington, calling it an effort to “unconstitutionally silence” his political speech. In court papers filed late Monday, attorneys for Trump urge U.S. District Judge Tanya Chutkan to deny the proposal to bar the Republican ex-president from making inflammatory and intimidating comments about witnesses, lawyers and other people involved in the criminal case. "If the prosecution wishes to avoid criticism for abusing its power, the solution is simple: stop abusing its power. Prosecutors told the judge that a “narrow, well-defined” order was necessary to preserve the integrity of the case and to avoid prejudicing potential jurors. There's a high bar for recusal, and Smith’s team has said there is no valid basis to have the judge removed from the case.

So from that perspective, if I’m DOJ, I’d much rather have a Miami jury pool than a Fort Pierce jury pool,” he added. Given its sprawling geographic size, the district has five courthouses — in Key West, Miami, Fort Lauderdale, West Palm Beach and Fort Pierce. “The bigger issue is going to become, can the Fort Pierce courtroom handle this case? “And if they send it to Miami, how are they going to get the jurors there because technically it’s not a Miami case." WASHINGTON (AP) — The Justice Department is challenging efforts by former President Donald Trump to disqualify the Washington judge presiding over the case charging him with plotting to overturn the results of the 2020 election. Prosecutors with special counsel Jack Smith's team wrote in a court filing late Thursday that there was “no valid basis” for U.S. District Judge Tanya Chutkan to recuse herself. Chutkan did not say, prosecutors wrote, that Trump was legally or morally to blame for the events of Jan. 6 or that he deserved to be punished. The defendant cannot meet this heavy burden.”Trump's motion is unlikely to succeed given the high standard for recusal. WASHINGTON (AP) — Federal prosecutors in the case charging Donald Trump with scheming to overturn the 2020 presidential election are alleging that the former president has targeted individuals with threats, harassment and inflammatory statements, a judge said Friday. U.S. District Judge Tanya Chutkan made the revelation in an order permitting special counsel Jack Smith's team to file a redacted motion on the topic that will black out the names and identifying information of the individuals who say they have been targeted. “The history of harassment and threats towards the individuals whose information has been redacted demonstrates the real likelihood that they could suffer further intimidation upon disclosure of their identities,” Chutkan wrote. “And the government’s proposed redactions are tailored to mitigate that risk, covering only those individuals’ identifying information in a handful of instances and the witness interview transcripts.”Copyright 2023 The Associated Press. The IT manager struck a cooperation deal and testified before a federal grand jury. A cooperation agreement generally requires an individual to assist a criminal investigation in exchange for not being prosecuted. Former President Donald Trump plans to turn himself in and be processed at the Fulton County jail in Atlanta on Thursday after a grand jury indicted him on state charges related to the Georgia election subversion case. Fulton County District Attorney Fani Willis accuses Trump, former White House chief of staff Mark Meadows, ex-Trump attorney Rudy Giuliani and others of being part of a broad "criminal enterprise" after Trump lost the election in Georgia. Earlier this month, he was indicted by a federal grand jury in special counsel Jack Smith's investigation into efforts to overturn the 2020 election leading up to the January 6, 2021, attack on the US Capitol. In June, a federal grand jury in Florida charged Trump in Smith's classified documents probe, and in March, a Manhattan grand jury indicted the former president on business fraud charges related to a hush money payment to an adult film star. Trump, who is running for president in 2024 and is the GOP front-runner, has repeatedly denied wrongdoing and accused Democrats of targeting him politically.
